TERMS AND CONDITIONS FOR THE ONLINE PURCHASE OF TRAVEL TICKETS

1. Company information

The website www.navromdelta.ro and the online ticket sales system are operated by:

NAVROM DELTA S.A. TULCEA, hereinafter referred to as the “Company” or the “Operator”;

NAVROM DELTA S.A. provides passenger transport services on inland waterways between the Municipality of Tulcea and the localities in the Danube Delta.

2. Purpose of the document

This document sets out the terms and conditions applicable to the purchase, through the Company’s website, of passenger transport tickets.

The Terms and Conditions mainly govern:

  • selection of the service and passenger category;
  • submission of the order;
  • online payment;
  • issuance and delivery of the ticket or voucher;
  • amendment or cancellation of the order;
  • refund of the amounts paid;
  • use of the ticket purchased online;
  • handling of complaints.

By ticking the “I have read and agree to the Terms and Conditions” box and completing the order, the purchaser confirms that they have read, understood and accepted this document.

3. Conditions for using the online sales system

Tickets may be purchased online by persons who:

a) have the legal capacity to enter into contracts;

b) provide true, complete and accurate information;

c) have a valid e-mail address;

d) use a payment method accepted by the system;

e) accept this document and the Personal Data Processing Information Notice.

Persons under the age of 18 may purchase tickets online only with the consent of their legal representative.

A person purchasing tickets for other passengers is required to communicate to them the information concerning the journey and the applicable conditions.

4. Steps for purchasing a ticket online

To purchase a ticket, the purchaser must complete the following steps:

  1. selecting the journey type: one-way or round trip;
  2. selecting the route;
  3. selecting the date and time of the service;
  4. selecting the number and category of passengers;
  5. entering the requested information;
  6. checking the information entered;
  7. reviewing the total price;
  8. accepting the Terms and Conditions and the data protection information;
  9. making the payment;
  10. receiving the order confirmation and the ticket or voucher.

Before making the payment, the purchaser must carefully check:

  • the route;
  • the place of departure;
  • the destination;
  • the date and time;
  • the direction of travel;
  • the number of passengers;
  • the fare category;
  • the contact details;
  • the total price.

The Company shall not be liable for the purchaser selecting the wrong service or entering incorrect information.

5. Seat availability

The display of a service on the website does not guarantee a seat reservation until the order has been completed, the payment confirmed and the ticket issued.

Seats are available within the vessel’s capacity and the number of seats allocated for online sale.

The Company may stop online sales for a particular service if:

  • the available seats have been sold out;
  • the service has been suspended or changed;
  • there are technical problems;
  • there are navigation restrictions;
  • sales have been stopped for operational or safety reasons.

6. Fares applicable to tickets purchased online

The ticket price is the price displayed in the system when the order is completed.

Tickets purchased online are subject to the fares displayed for conventional vessels, regardless of the category of vessel operating the service, unless otherwise specified on the order page.

The total price will be presented to the purchaser before payment is made.

The Company will not charge any additional payments without the purchaser’s express consent. Options involving additional costs must not be selected automatically.

Subsequent changes to fares do not affect tickets already purchased and confirmed.

7. Ticket categories available online

The ticket categories available in the system at the time the order is placed may be purchased or requested through the website.

7.1. Full-fare tickets

Full-fare tickets are issued after payment has been confirmed and are valid for the selected service, date, route and number of passengers.

7.2. Children under 7 years of age

Children under 7 years of age are entitled to free travel under the applicable legislation.

For this category, the system may send by e-mail a voucher that will be exchanged or validated at the ticket office or upon boarding, based on the birth certificate or another accepted supporting document.

7.3. School pupils

School pupils entitled to free travel will receive, where applicable, a voucher at the e-mail address provided.

The travel ticket will be issued or validated upon presentation of the supporting documents required by the legislation in force.

7.4. Other passenger categories

Tickets for pensioners, persons with disabilities and persons entitled to a subsidised fare are purchased using the methods indicated on the website.

The subsidised fare is not available through the online system and is granted at the ticket office or through the other methods announced by the Company, based on supporting documents.

If the supporting documents are not presented or are not valid, the passenger may be required to pay the full fare.

8. Online payment

Payment for tickets is made using the methods available on the order completion page.

Card payments are processed through an authorised payment service provider.

The Company does not request or store full bank card details when they are entered directly on the payment processor’s secure page.

The purchaser is responsible for:

  • the lawful use of the payment instrument;
  • the availability of the necessary funds;
  • the accuracy of the information entered;
  • authorisation of the transaction.

The transaction may be declined by the issuing bank or the payment processor, and such refusal shall not be attributable to the Company.

An order for which payment has not been authorised is not considered completed.

9. Completion of the order and conclusion of the contract

The contract of carriage is considered concluded once all of the following conditions have been met:

a) the order has been submitted;

b) payment has been authorised and confirmed, if the ticket requires payment;

c) the Company has confirmed the order;

d) the ticket, voucher or booking confirmation has been issued.

Merely completing the form or initiating a payment does not constitute conclusion of the contract.

The button used to complete the payment must clearly indicate that submitting the order creates an obligation to pay, for example: “Pay and complete the order” or “Order with obligation to pay”.

10. Issuance and delivery of the ticket

After the order has been completed, the purchaser will receive at the e-mail address provided:

  • the order confirmation;
  • the electronic ticket; or
  • the voucher, when issuance of the travel ticket requires verification of documents.

The purchaser is required to enter a correct e-mail address and to check the “Spam”, “Junk” or “Unwanted Messages” folders as well.

If payment has been made but the ticket has not been received, the purchaser must contact the Company at info@navromdelta.ro or by telephone at 0240 511 553.

The purchaser must not make another payment before checking the status of the first transaction.

11. Validity of the electronic ticket

The ticket purchased online is valid only for:

  • the specified route;
  • the specified date;
  • the selected time and service;
  • the direction of travel;
  • the passenger category;
  • the number of persons stated on the ticket.

The ticket may be presented upon boarding:

  • on a phone or another electronic device;
  • printed on paper;
  • in the form accepted and communicated by the Company.

The ticket, QR code, serial number or identification code must be legible.

It is prohibited to alter, counterfeit, duplicate or resell the ticket, or for the same ticket to be used by several persons.

The ticket is considered used after it has been validated upon boarding.

12. Presentation for boarding

The passenger must arrive at the boarding point at least [30 minutes] before the scheduled departure time.

Upon boarding, the passenger shall present:

  • the electronic ticket or voucher;
  • an identity document, if required;
  • supporting documents for free travel or a discount, where applicable.

Failure by the passenger to arrive before boarding operations close is considered a no-show for the service.

The vessel cannot be held beyond the scheduled departure time due to a passenger’s delay.

13. Ticket changes at the purchaser’s request

The route, date, service or passenger category may be changed only if permitted by the Company’s technical and commercial procedure.

The change is subject to:

  • the availability of seats;
  • compliance with the deadline established by the Company;
  • payment of any fare difference;
  • provision of the original order details.

Policy applicable to changes

Change requests are accepted if submitted at least [24 hours] before departure.

No charge is made for the change:

[no fee is charged].

If the new ticket has a higher price, the purchaser shall pay the difference.

If the new ticket has a lower price, the difference:

[will be refunded].

14. Cancellation of the ticket by the purchaser

Passenger transport tickets purchased online are not covered by the general 14-day right of withdrawal applicable to other distance contracts.

Passenger transport services are exempt from this right pursuant to Article 3(3)(j) of Government Emergency Ordinance No. 34/2014.

Voluntary cancellation of the ticket is carried out exclusively in accordance with the commercial policy approved by NAVROM DELTA S.A.

Cancellation and refund policy

Option to be approved by the Company:

a) for cancellations requested at least [24 hours] before departure, after verification, the full amount of the ticket price shall be refunded;

b) payment processor fees may be withheld only if they were actually incurred by the Company, were communicated to the purchaser and their withholding is permitted by law.

The cancellation request must include:

  • the purchaser’s name;
  • the e-mail address used;
  • the order number;
  • the ticket serial number;
  • the route and travel date;
  • proof of payment;
  • the bank account, if necessary.

15. Refund of amounts

Approved refunds are generally made using the same method by which the payment was made.

The refund period is a maximum of [14 working days] from approval of the request.

The actual time in which the amount appears in the account also depends on the issuing bank or payment processor.

In the event of a confirmed duplicate payment, the additional amount collected will be refunded in full.

16. Cancellation or modification of the service by the Company

The Company may change the departure time, vessel category or boarding point, or may cancel the service for reasons such as:

  • adverse hydro-meteorological conditions;
  • navigation restrictions;
  • technical failures;
  • orders issued by the authorities;
  • works on pontoons or berthing infrastructure;
  • situations affecting passenger safety;
  • fortuitous events or force majeure.

The Company reserves the right to change the vessel category according to operational requirements.

If a service is cancelled by the Company, the passenger may be entitled, as applicable, to:

  • rescheduling of the journey at no additional cost;
  • rerouting to another available service;
  • a full refund of the price paid for the untravelled segment of the journey.

Passengers’ rights in the event of cancellation or delay are granted under the conditions and within the limits laid down in Regulation (EU) No. 1177/2010 concerning the rights of passengers when travelling by sea and inland waterway.

17. Technical errors and website unavailability

The Company makes reasonable efforts to ensure the operation of the online sales system.

The Company does not guarantee uninterrupted operation of the website and may temporarily suspend access for:

  • maintenance;
  • updates;
  • the remediation of security issues;
  • server failures;
  • problems affecting internet or payment service providers;
  • other causes beyond the Company’s control.

If an obviously incorrect price is displayed due to a technical problem, the Company may cancel the order and will refund the amount paid in full.

18. User account security

If the purchaser uses an account on the website, they are responsible for:

  • keeping the password confidential;
  • activity carried out through the account;
  • updating the contact details;
  • informing the Company in the event of unauthorised access.

The Company may suspend an account if fraud, unauthorised access or abusive use of the system is suspected.

19. Processing of personal data

The Company processes the personal data necessary for:

  • registering and processing the order;
  • issuing the ticket or voucher;
  • collecting and verifying payment;
  • sending communications concerning the journey;
  • verifying entitlement to transport concessions;
  • handling requests and complaints;
  • fulfilling accounting and legal obligations.

The following data may be processed, as applicable:

  • first name and surname;
  • e-mail address;
  • telephone number;
  • journey information;
  • billing details;
  • passenger category;
  • payment information, without the Company retaining full card details.

20. Complaints and requests

Requests concerning tickets purchased online may be submitted to:

The request must include:

  • the person’s name;
  • contact details;
  • the order number;
  • the ticket serial number;
  • the route and travel date;
  • a description of the situation;
  • supporting documents.

Under the conditions provided by law, the passenger may also refer the matter to the National Authority for Consumer Protection or to the competent courts.

21. Amendment of the Terms and Conditions

The Company may amend this document in the event of changes to:

  • legislation;
  • payment methods;
  • the booking system;
  • fare rules;
  • internal procedures;
  • the services available online.

Each order is subject to the version of the Terms and Conditions accepted on the date it was placed.

The amendments do not retroactively affect the rights relating to orders that have already been confirmed.

22. Governing law

This document and the contracts concluded through the website are governed by Romanian law and the applicable legislation of the European Union.

Any disputes shall first be settled amicably and, if this is not possible, by the competent courts in accordance with the law.

No provision of this document may limit the mandatory rights granted to consumers and passengers under the legislation in force.

23. Acceptance of the Terms and Conditions

Before completing the order, the purchaser will tick the following declaration:

I declare that I have read and accept the Terms and Conditions for the online purchase of tickets, that I have checked the route, date, time, category and number of passengers, and that I have been informed of the amendment, cancellation and refund policy.”

Acceptance of the Terms and Conditions must not be automatically selected by the system.
